All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. MOZA ISACK reserves the right to accept or decline your order for any reason. Your order is not accepted until MOZA ISACK confirms acceptance.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy and applicable EU consumer law.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

4.1 Currency and VAT

All prices are denominated in Euro (EUR) and include French VAT (TVA) at the applicable rate (standard rate: 20%). Shipping fees will be added to the final price and displayed separately at checkout. Our intra-community VAT number is: FR96103906525.

4.2 Pricing Policy

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. In the event of an obvious pricing error, we will offer you the opportunity to purchase the product at the correct price or cancel the order without any cancellation fees.

4.3 Promotions

We may offer promotions on the Services that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern. Promotions and benefits may not be combined unless explicitly stated otherwise.

4.4 Payment Methods

Payment must be made using a valid credit or debit card accepted in the European Union, including: Visa, Mastercard, American Express, Diners Club, and CB (Carte Bancaire). We also accept PayPal, Apple Pay, and Google Pay where available.

4.5 Purchase Limits

Up to 3 orders per day per customer (by email address) may be placed, with a cumulative total of up to 10,000 EUR per order.

SECTION 5 — SHIPPING AND DELIVERY

5.1 Delivery Area

We deliver to all 27 European Union member states, the United Kingdom, Switzerland, the United States and Canada. For deliveries outside the EU (UK, Switzerland, USA, Canada), additional customs duties or import taxes may apply and are the responsibility of the recipient.

5.2 Business Days

Monday through Friday, excluding French public holidays and official holiday eves.

5.3 Processing Times

Orders received by 12:00 PM (CET) will be processed on the same business day. Orders received after this time will be processed on the next business day.

5.4 Delays

All delivery times are estimates only and are not guaranteed. We are not liable for shipping and delivery delays caused by shipping carriers, customs processing, or events outside our control (force majeure).

SECTION 6 — INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, images, graphics, video, and audio are owned by MOZA ISACK, its affiliates or licensors and are protected by French, EU and international intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only.

SECTION 7 — OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. We provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind.

We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. SECTION 9 — RELATIONSHIP WITH SHOPIFY

MOZA ISACK is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with MOZA ISACK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MOZA ISACK.

SECTION 10 — PRIVACY POLICY AND GDPR

All personal information we collect through the Services is subject to our Privacy Policy, and is processed in accordance with Regulation (EU) 2016/679 (GDPR). By using the Services, you acknowledge that you have read our Privacy Policy.

As a data subject under GDPR, you have the following rights: the right to access, rectify, erase, restrict processing, data portability, and to object to processing of your personal data. SECTION 11 — BENEFITS AND COUPON POLICY

11.1 Sign-Up Benefit

Signing up for our newsletter grants a 10% discount on the first purchase only. You may unsubscribe at any time.

11.2 Discovery Box

Purchasing a Discovery Box grants a voucher equal to the cost of the box, valid for redemption within 3 months. The voucher will be sent by email and is non-transferable and non-refundable.

11.3 Coupon Redemption

The coupon code must be entered exactly as provided at checkout. Coupons cannot be applied retroactively after an order has been completed.

SECTION 12 — ORDER CANCELLATION AND RETURNS

12.1 Right of Withdrawal (EU Consumer Rights Directive 2011/83/EU)

As a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving the product, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU) and French law (Loi Hamon).

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g. a letter sent by registered mail or email to info@mozaisack.com) before the 14-day withdrawal period has expired. You may use the standard withdrawal form provided on our Returns page, but it is not obligatory.

12.2 Return Conditions

The product must be returned in its original packaging, unused and in its original condition. Spraying, applying, or opening the packaging constitutes use and returns may not be accepted in such cases, except where the product is defective. To initiate a return, please contact info@mozaisack.com.

12.3 Cancellation Fees

In accordance with EU consumer law, no cancellation fee will be charged for withdrawals made within the 14-day cooling-off period.

12.4 Vulnerable Consumers

Senior citizens and persons with disabilities benefit from the same 14-day withdrawal right as all EU consumers. Please contact us at info@mozaisack.com for assistance.

12.5 Refunds

We will reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than 14 days from the day we receive the returned goods.

SECTION 13 — FEEDBACK

If you submit any ideas, suggestions, feedback, reviews, or proposals, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use.

SECTION 14 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

You may access and use the Services for lawful purposes only. You may not use the Services for any unlawful or malicious purpose, to violate any regulations or laws, to infringe upon intellectual property rights, to harass or harm any person, to transmit false or misleading information, or to send any advertising or promotional material without our consent.

We may terminate this agreement or your access to the Services in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

EXCEPT AS EXPRESSLY STATED BY MOZA ISACK AND AS REQUIRED BY APPLICABLE EU AND FRENCH LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND. NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER UNDER EU OR FRENCH LAW.

SECTION 19 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE EU AND FRENCH LAW, IN NO CASE SHALL MOZA ISACK, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND. NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION.

You agree to indemnify, defend and hold harmless MOZA ISACK, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims arising out of (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

As a consumer in the EU, you also retain the right to bring proceedings in the courts of your country of residence.
